Trademarks: registration, protection and enforcement in Paraguay

A trademark is one of a company's principal assets and allows it to distinguish its goods or services in the marketplace. AYALA IP advises on its registration, management, protection and enforcement in Paraguay, for domestic companies as well as clients and associates abroad.

Register your trademark

What we do

We accompany a trademark throughout its life cycle: from the preliminary risk assessment to post-registration watching.

  • Clearance searches and registrability analysis before filing.
  • Filing and prosecution of applications for goods and service marks, in the Nice classes that match the activity.
  • Responses to DINAPI office actions and defence of the application during prosecution.
  • Renewals, assignments, changes of name and address, and recordal of licences.
  • Portfolio management: deadline control, status reports and protection strategy by class.
  • Trademark watching: detection of identical or similar third-party applications and assessment of the action needed to defend the owner's rights.

How registration works

A trademark in Paraguay is registered before the National Directorate of Intellectual Property (DINAPI). In general terms, the application goes through a formal examination, publication, an opposition period and a substantive examination before it may be granted.

Timelines may vary depending on the circumstances of each application and on whether office actions or oppositions arise. For every matter we keep the client informed of its status and the next steps.

For international clients and foreign associates

Paraguay is not a member of the Madrid Protocol: extending a foreign trademark to the country means filing a national application through a local agent. We take instructions, set out the documentary requirements and per-class costs, file the application claiming Paris Convention priority where applicable, and report every stage with the clarity a head office or an associate firm expects.

Frequently asked questions

How long does it take to register a trademark in Paraguay?

It depends on DINAPI's workload and on whether the application receives oppositions from third parties or ex officio objections from DINAPI. For each case we give a realistic written estimate and update the status as the matter progresses.

Is a clearance search mandatory before filing?

It is not mandatory, but it is highly advisable: it reveals earlier identical or similar marks, lets us assess the risk of oppositions or objections and adjust the sign if necessary before investing in the application.

Can I extend a trademark registered elsewhere to Paraguay through the Madrid Protocol?

No. Paraguay is not a party to the Madrid Protocol, so the mark must be applied for directly before DINAPI through a local agent. If the home application is less than six months old, Paris Convention priority can be claimed.

What happens if I do not use my registered trademark?

Paraguayan law allows a registration to be cancelled for non-use at the request of an interested third party once the statutory period has elapsed. It is therefore wise to plan genuine use of the mark and to keep evidence of that use.
